My Journey Promotion

Thank you for entering Lonely Planet's "My Journey" promotion ("Promotion").

Who is involved in running this Promotion?

The promoter is Lonely Planet Publications Inc., a Delaware corporation with a principal office located at 150 Linden Street, Oakland, California, 94647 ("Lonely Planet"). Google Inc., a Delaware Corporation with a principal office located at 1600 Amphitheatre Parkway, Mountain View, CA 94043 and T-Mobile U.S.A. Inc., a Delaware Corporation, located at 12920 SE 38th Street, Bellevue, WA 98006 are Promotion partners. Marden-Kane Inc., located at 36 Maple Place, Manhasset, NY, 11030 is the Promotion administrator. Instructions and information on how to enter and YouTube's Terms of Use, Community Guidelines and Privacy Policy form part of these conditions of entry ("Conditions of Entry"). By entering the Promotion, you agree that these Conditions of Entry apply to your entry and that the decisions of Lonely Planet or, where relevant, its Promotion partners or the Promotion administrator decisions will be final.

Eligibility

This Promotion is open only to full time legal residents of the United States who are as of August 28, 2009, at least 18 years of age or older. The laws in some places do not allow Lonely Planet to run this Promotion, in which case the Promotion and these Conditions of Entry are void in those places. Any entries received from outside the United States are invalid. Also, you cannot enter this Promotion if you (or your immediate families or members of your household) are employed by Lonely Planet, Google Inc., T Mobile U.S.A Inc., or Marden-Kane Inc., or their subsidiaries and affiliated companies. Professional filmmakers are not permitted to enter. Your entry must be your own new original work, not subject to any third party rights (contractual or otherwise) and must not infringe any third party intellectual property or contractual rights.

To Enter

To enter you must submit a video, at www.youtube.com/lonelyplanet, in which you share your American journey. The Promotion is divided into the following 5 categories:

  • 'No Place Like Home' (Tell us about your neighbourhood, hometown, favorite spot);
  • 'The Great Outdoors' (Show us where you enjoy nature);
  • 'Encounters' (Showcase the great people you have encountered on your journeys);
  • Cities (Top Cosmopolitan destinations); and
  • 'Best Kept Secrets' (Your favorite unknown travel spots).

The maximum length of your entry into a category cannot be greater than 3 minutes. Only one entry per person per category is permitted. To enter you must be a registered user ("Registered User") of the YouTube website (located at www.youtube.com). Although there may be more than one person who has been involved in the making or more than one person appearing in the video, ONLY one person will be eligible to win the prizes. Only the person with the Registered User account through which the video is submitted on www.youtube.com/lonelyplanet will be eligible to win the prizes. No joint or group entries will be permitted. No payment or purchase of any kind is necessary to enter the Promotion, and there is no fee or charge to become a Registered User.

By entering you warrant and represent that your entry conforms to all aspects of the Conditions of Entry and that:

  1. your entry is your own original work;
  2. at the time of submitting your entry or any time thereafter, your entry does not contravene any contractual, legal or other obligation;
  3. at the time of submitting your entry or any time thereafter, your entry does not infringe the intellectual property rights of any third party including, but not limited to, any rights associated with any music contained in your entry;
  4. you have the relevant permission, where required, to use any third party intellectual property and images or likeness of any person contained in your entry; and
  5. in producing your video you have complied with all relevant laws, rules and regulations.

Contest Schedule

Promotion Submission Period: You can enter between 12:00:01 am US Pacific Time Zone on August 28, 2009 and 11:59:59pm US Pacific Time Zone on October 25, 2009 ("Promotion Submission Period"). Entries must be received during the Promotion Submission Period. No responsibility is accepted for late, lost, misdirected or illegible/inaudible entries. This is a game of skill and chance plays no part in determining the winner.

Screening Period: All entries will be screened by the Promotion administrator to ensure that entries in the Promotion conform to these Conditions of Entry. The Screening Period will occur during the Promotion Submission Period and end on October 26, 2009 at 11:59:59pm US Pacific Time Zone. The Promotion administrator reserves the right to invalidate any entry submitted that does not conform to these Conditions of Entry. The Promotion administrator's decision is final and binding in all respects.

Judging Period: All eligible entries received during the Promotion Submission Period will be judged by a panel of judges appointed by Lonely Planet. The Judging Period will be conducted between 12:00:01 am US Pacific Time Zone on October 26, 2009 and 11:59:59pm US Pacific Time Zone on November 1, 2009. The best valid entry in each of the 5 categories, as determined by the judges, based upon, among other things:

  1. Literary merit;
  2. Creative merit;
  3. Originality;
  4. Entertainment value; and
  5. Video graphic skill;

will then compete for the grand prize ("Finalists"). The judges' decision is final and binding in all respects. The Finalists will be notified via their Registered User account on or before November 1, 2009.

Community Voting: Each Finalist's entry will be posted on YouTube at www.youtube.com/lonelyplanet, for voting by Registered Users. Community voting will take place between 12:00:01 am US Pacific Time Zone on November 2, 2009 and 11:59:59pm US Pacific Time Zone on November 15, 2009 (the "Community Voting Period"). Finalists may not vote for their own entry, and votes are limited to one vote per Registered User per Finalist per day. Lonely Planet reserves the right to disqualify any Finalist who tampers with or influences, or benefits from tampering with or influencing, the entry process or the Promotion. The Finalist with the highest number of recorded Registered User votes during the Community Voting Period will be declared the winner. The Promotion administrator reserves the right to select the next most highly ranked Finalist as an alternate winner if it determines in its sole discretion that the winning Finalist does not adequately satisfy the Conditions of Entry or are otherwise subject to disqualification. In the event of a tie at the end of the Community Voting Period, Lonely Planet, using the judging criteria described in these Conditions of Entry, will determine the winner in its sole discretion. The winner will be notified via their Registered User account and by posting their names on the Lonely Planet website on or before November 23, 2009. The winning entry will be displayed on www.youtube.com/lonelyplanet and www.lonelyplanet.com between 12:00:01 am US Pacific Time Zone on November 23, 2009 and 11:59:59pm US Pacific Time Zone on December 6, 2009.

What can I win?

Grand Prize consists of: An opportunity to conduct a video assignment for Lonely Planet in San Francisco, which includes:

  • Economy airfare for the winner and 1 guest to and from San Francisco from the winner's nearest major US city;
  • 7 days and 6 nights accommodation in San Francisco for winner and 1 guest at a hotel with a daily rate equivalent to, but not greater than, $250 per day;
  • Half-day training from Lonely Planet staff on how to create engaging travel videos;
  • Provision of a rental SUV at a daily rate not greater than $100 and with a daily gas allowance of $50;
  • a Sony DCR-VX2100 Digital Camcorder;
  • Editing software (Final Cut Pro or equivalent software);
  • $200 a day daily allowance for spending, meals and other necessities while in San Francisco and on assignment; and
  • Subject to final approval by Lonely Planet, the opportunity for your completed video assignment to be featured on LonelyPlanet.com, LonelyPlanet YouTube channel, and the YouTube homepage.

Total Grand Prize Approximate Retail Value (ARV) is $10,000. All travel associated with the Grand Prize must be taken within 6 months of being awarded.

Finalist Prize consists of: Each individual category winner will receive a:

  • New Flip Ultra HD Video camera;
  • Copy of the Lonely Planet USA Book: A Journey Through America; and
  • Complete series of the Lonely Planet U.S. Trips guidebooks.

Total Finalist Prize ARV is $380 each.

These prize values are accurate at the start of the Promotion, and any change after the Promotion begins is beyond Lonely Planet's control.

General Conditions

Prizes are not transferable or exchangeable and cannot be taken as cash. Where any of Lonely Planet, the Promotion partners or the Promotion administrator makes a decision in accordance with the Conditions of Entry, such decision is final and binding in all respects. If a prize, or element of a prize, is unavailable for any reason, Lonely Planet reserves the right to substitute another prize of equal or greater value for that prize, or element of it, subject to the approval of any relevant authority where required.

Lonely Planet accepts no responsibility for any tax implications that may arise from winning the prizes.

The winner is responsible for all insurance and any other expenses, fees and costs connected with the Grand Prize that are not included in the prize description.

Before we can give you your prize, you and your guest will have to sign an eligibility and publicity release (unless prohibited by law), and other agreements as may be required by Lonely Planet ("Releases"). These Releases will say that if anything goes wrong with your prize once it's been awarded, you agree that Lonely Planet and its Promotional partners and Promotion administrator will not be responsible, to the extent permitted by law, and that you consent to use of personally identifying information, including but not limited to your name, city, state, photo, image or likeness for promotional, advertising and publicity purposes without any additional payment to you. If you fail to properly execute and return the Release, you will be disqualified and, at the sole discretion of the Promotion administrator, the next highest scoring entrant will be selected to the extent permitted by law.

This Promotion is governed by US law, and any and all actions of claims arising in connection with this Promotion must be brought in a court of competent jurisdiction in Santa Clara, California. You waive all rights to claim or be awarded any direct, indirect, incidental, punitive or consequential damages, and any other damages, except what you spend out of pocket, but in no event attorneys' fees.

Lonely Planet, its Promotion partners and Promotion administrator will never be liable for any indirect, incidental, special or consequential loss, or loss of profits or revenue arising out of your participation in this Promotion. You indemnify Lonely Planet, the Promotion partners and Promotion administrator and any of their associate companies against each claim, action, proceeding, judgment, damage, loss, expense or liability incurred or suffered by, or brought, made or recovered against Lonely Planet, the Promotion partners and the Promotion administrator or their associated companies, including but not limited to:

  1. any breach of these Conditions of Entry; or
  2. any infringement by you of the intellectual property rights of any third party.

Sorry, but this contest is not open to residents of Cuba, Iran, North Korea, Sudan, Myanmar/Burma, Syria and any other U.S. sanctioned country and is void where prohibited by law.

What happens to my entry?

You own your submission according to the terms of your Registered Account. By entering this Promotion, you also give Lonely Planet and the Promotional partners a non-exclusive, perpetual, royalty-free, worldwide, irrevocable licence to reproduce, publish, adapt, modify, communicate and broadcast all or part of the entry in any form and media, and to sublicense those rights (including to our related companies, licensee publishers and partners). You also consent to us editing, re-using, storing, reproducing and communicating your entry in any medium for any purpose including but not limited to loading it onto any of the Lonely Planet or Promotional partner websites, online or wireless applications, for use for marketing and publicity purposes and for re-use within any other Lonely Planet programs.

Lonely Planet, its Promotion partners and administrator and their agencies and companies associated with this Promotion will not be liable for:

  1. any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person's negligence) relating to this Promotion except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law); or
  2. any problems or technical malfunction of any telephone network or lines, computer on-line systems, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this Promotion.

Lonely Planet may use any personal information you provide in connection with this Promotion for the purpose of running the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. Lonely Planet may disclose the information for those purposes to its related bodies corporate and contractors, and to the Promotional partners and administrator.
